Dagger Kayak Sweepstakes
ELIGIBILITY
NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Sweepstakes is open only to legal residents of the United States (excluding Puerto Rico) who are 18 years or older at time of entry. Entries are limited to individuals only; commercial enterprises and business entities are not eligible. Employees or contract employees of Teva, Untraditional Marketing, Mountain Games, Dagger Kayaks and their affiliates, subsidiaries, agents, and parents and their immediate families or persons living in the same household of such individuals, are ineligible. SWEEPSTAKES IS VOID IN PUERTO RICO AND WHERE PROHIBITED BY LAW.

SCHEDULE
The sweepstakes begins on July 20th, 2008 and ends at midnight on September 30th, 2008 at 11:59 pm (PST). Entries must be received by 11:59 pm (PST), September 30th, 2008.
HOW TO ENTER
There is a limit of one (1) entry per person. Subsequent entries will be disqualified. To enter, go to www.tevamountaingames.com and follow the directions for online entry.
All entries become the property of Sponsor. They will not be returned or acknowledged. Sponsor is not responsible for lost, late, misdirected, mutilated, incomplete, illegible entries. Entries are void if they are in whole or in part illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error, or obtained through fraud or theft. By entering you agree to be bound by these Official Rules.
Entries will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
If the potentially winning entry is an Internet or other computer entry, potential winner may be requested to provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry.
PRIZE
One (1) Dagger Whitewater Mamba Kayak. Approximate Retail Value ("ARV") of the Dagger Mamba Kayak is $925.00 USD. Actual retail value may vary based on location of Dagger Kayak winner's residence and other variables. Any difference between approximate retail value and actual retail value will not be awarded. No prize transfer, assignment, or substitution by Dagger Kayak winner permitted. Sponsor reserves the right to substitute prize in which case a prize of equal or greater value will be awarded.
WINNER SELECTION
Random selection of the Dagger Kayak winner will occur on or about September 30th, 2008, from among all eligible entries received. The Dagger Kayak winner will be notified by e-mail or by phone on or about October 7th, 2008. Prize will be awarded. Odds of winning depend on the number of eligible entries received.
REDEMPTION AND VERIFICATION
To redeem the prize, the Dagger Kayak winner must respond within fifteen (15) days of prize notification. Dagger Kayak winner will be required to submit their shipping address and sizing information to Untraditional Marketing. Failure to comply will result in the forfeit of the Dagger Kayak and the selection of a substitute Dagger Kayak winner from remaining eligible entries.
All prize claims are subject to verification and compliance with the official rules.
LIMITATION ON LIABILITY
Sponsors assume no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to sweepstakes entries or entry forms; or alteration of entries or entry forms. Sponsor is not responsible for any problems with or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any e-mail or mailed-in entry to be received on account of technical problems or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participants' or any other persons' computers related to or resulting from participation or downloading any materials in this sweepstakes.
CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
RIGHT TO CANCEL OR SUSPEND SWEEPSTAKES
If for any reason the sweepstakes is not capable of running as planned, due to tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this sweepstakes, the Sponsor reserves the right, at its sole discretion, to disqualify any individual(s) who tamper with the entry process, and/or to cancel, terminate, modify, or suspend the sweepstakes.
CONDITIONS OF PARTICIPATION
By accepting the Dagger Kayak Grand Prize, the winner must be willing to accept the risk in using the products won in the sweepstakes and to confirm their acceptance of such risk in writing at Sponsor's request. Participants agree to release, discharge and hold harmless Teva, Untraditional Marketing, Dagger Kayaks and their partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in this sweepstakes or any sweepstakes-related activities and the acceptance and use, misuse, or possession of any prize awarded hereunder. Participants also agree (a) to be bound by these official rules; (b) that the decisions of Sponsor are final on all matters relating to the sweepstakes; and (c) if he/she wins, to the use of his/her name and or likeness for advertising and promotional purposes without compensation (except in Tennessee and where prohibited by law) and upon request, to provide consent to such use in writing.
All federal, state and local taxes, fees and surcharges on prize are the sole responsibility of the Dagger Kayak Winner. If the Dagger Kayak Winner declines the prize or is unavailable for prize fulfillment, an alternate winner will be selected at random from all remaining eligible entries.

For Dagger Kayak winner's name after September 30th, 2008, send a separate self-addressed, stamped envelope to Untraditional Marketing dba Teva Mountain Games at Mailing Address: P.O. Box 1430, Vail, CO 81658.
NOTICE TO INDIVIDUALS: REMOVAL FROM MAILING LIST:
Any individual (or duly authorized person) may elect to exclude the name and address of that individual from all lists used by Sponsors to mail sweepstakes. To elect to have an individual's name excluded from all such lists, submit a removal request in writing to Untraditional Marketing at Mailing Address. The notification system may be used to prohibit mailing of all skill contests or sweepstakes by Sponsors to such individual. |
